Equipment Rental Agreement

1. Parties and Equipment

This Equipment Rental Agreement ("Agreement") is between Pikes Peak Thermal LLC, a Colorado limited liability company ("Owner"), and the renter identified at booking ("Renter").

Owner rents to Renter one FLIR C3-X thermal imaging camera, including its charging cable and carrying accessories (together, the "Equipment"), for the rental period selected at booking.

2. Tool Rental Only — No Inspection Services

This is a rental of equipment only. Owner is not performing an inspection, energy audit, or any professional service. Renter operates the Equipment personally and is solely responsible for how it is used and how its output is interpreted.

Thermal images can be affected by weather, surface materials, operator technique, and many other factors. Any images or AI-assisted summaries associated with this rental are for educational and informational purposes only and are not a substitute for a professional home inspection, electrical inspection, energy audit, or any other professional service.

3. Rental Period, Pickup, and Return

Pickup and return occur in person at Fred McKown Park, Colorado Springs, Colorado, at the times selected at booking.

Late returns are charged $10 per hour or fraction thereof, up to the daily rate. Equipment not returned within 48 hours of the scheduled return time and without contact from Renter will be treated as unreturned, and the full replacement cost will be charged to Renter's card on file.

4. Payment, Deposit, and Card Authorization

The rental fee is charged in full at booking. At or before pickup, Owner will place a $100 authorization hold ("Deposit") on the payment card Renter provided at booking.

Renter authorizes Owner to capture some or all of the Deposit, and to charge the same card for any amounts owed under this Agreement that exceed the Deposit — including repair costs, replacement costs, and late fees. If the Equipment is returned on time and in good condition, the Deposit hold is released in full.

5. Condition, Care, and Liability for Damage

Renter accepts the Equipment in good working order and agrees to return it in the same condition, normal handling wear excepted. Owner photographs the Equipment before and after each rental.

Renter is fully liable for loss, theft, and damage to the Equipment from any cause during the rental period, up to full replacement cost. No damage waiver is offered or included. Repair and replacement charges follow the published Damage Fee Schedule at pikespeakthermal.com/policies.

Renter agrees not to open, modify, or attempt to repair the Equipment; not to expose it to water beyond its rated protection, extreme heat, or drops; and not to leave it unattended in a vehicle or public place.

6. Cancellation Policy

Cancellations 48 or more hours before the scheduled pickup receive a full refund. Cancellations between 24 and 48 hours before pickup receive a 50% refund. Cancellations less than 24 hours before pickup are not refundable.

7. Assumption of Risk and Limitation of Liability

Renter assumes all risk arising from possession and use of the Equipment. To the maximum extent permitted by Colorado law, Owner is not liable for any indirect, incidental, or consequential damages, or for any decision Renter makes based on thermal images or reports. Owner's total liability under this Agreement will not exceed the rental fee paid.

Renter agrees to indemnify and hold Owner harmless from claims arising out of Renter's use of the Equipment.

8. Privacy

Images stored on the Equipment are exported and the camera's storage is wiped after each rental. Exported images and any report generated for Renter are stored securely, used only to prepare Renter's report, and are not shared with third parties except as required by law. Renters are not given access to FLIR cloud services (FLIR Ignite) on Owner's account.

9. Governing Law and Jurisdiction

This Agreement is governed by the laws of the State of Colorado. Any dispute will be resolved in the state courts located in El Paso County, Colorado, and the parties consent to that venue.

10. Acceptance

By checking the acceptance box during online booking, Renter signs this Agreement electronically, confirms they are at least 18 years old, and agrees to all terms above. The acceptance timestamp, together with the name, email, and phone number provided at booking, constitutes Renter's electronic signature.
